State AI and privacy laws
There is no single federal AI law. Executive Order 14365 (December 2025) directs federal agencies to push back on state AI laws, but those laws stay in force until they are changed or struck down. The ones we see most often:
- Comprehensive state privacy laws
- California, Texas, Colorado, Virginia and a growing list of other states give consumers rights over profiling and automated decisions, often with assessment duties.
- AI-specific state laws
- Texas TRAIGA (in effect since January 2026), the Colorado AI Act as replaced by SB 26-189 (applies from January 2027), and Illinois HB 3773 on AI in employment.
- Sector rules
- HIPAA, GLBA, PCI DSS, NYDFS Part 500 and FTC enforcement against deceptive AI claims apply regardless of state.
